Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Fundry website at fundry.io and the Fundry mobile application (collectively, the “Service”), provided by Fundry (“Fundry,” “we,” “us”).

By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Fundry provides comparative market analysis (CMA) tools for real estate investors, including comp sourcing, ARV estimation, deal modeling for fix-and-flip / rental / ground-up / BRRR strategies, market data, and saved-property workflows. Fundry is a software tool that surfaces and organizes information; it is not an appraisal, a brokerage, or financial, legal, tax, or investment advice.

2. Eligibility and Account

You must be at least 18 years old and able to enter into a binding contract to use the Service. You agree to provide accurate registration information and to keep it current. You are responsible for safeguarding your password and for any activity under your account. Notify us immediately at support@fundry.io if you suspect unauthorized access.

3. Acceptable Use

You agree not to:

  • scrape, harvest, or bulk-download data from the Service;
  • resell, redistribute, or sublicense Service data or output without our written permission;
  • reverse-engineer, decompile, or attempt to extract the source code of the Service;
  • use the Service to violate any law, infringe any rights, or harm minors;
  • interfere with or disrupt the Service, our infrastructure, or other users;
  • use the Service to send unsolicited communications or spam;
  • misrepresent your identity or impersonate any person or entity.

4. Data Sources and Accuracy

The Service surfaces public-record property data, MLS listing data licensed from Georgia MLS (GAMLS) via Bridge Interactive, and third-party valuation signals. We work to keep this information accurate and current but make no representation that it is complete, error-free, or fit for any particular purpose. Comparable sales, ARV estimates, rent projections, financing assumptions, and similar outputs are estimates only — you must independently verify any number you rely on for an investment decision.

5. MLS / IDX Compliance

MLS listing content is provided pursuant to the rules of Georgia MLS and is intended for personal, non-commercial use to identify prospective properties for purchase. Listings are courtesy of the listing brokerage as displayed; you may not redistribute MLS content outside the Service.

6. Subscriptions and Billing

Fundry currently offers free accounts. If we introduce paid plans, the applicable fees, billing terms, and cancellation policy will be presented to you before purchase. Unless stated otherwise, paid subscriptions auto-renew, and you can cancel future renewals from your account settings.

7. User Content

The Service lets you save notes, tag deals, mark favorites, and build custom CMAs. You retain ownership of the content you create. You grant Fundry a worldwide, royalty-free license to host, display, and process that content solely to operate and improve the Service for you.

8. Intellectual Property

The Service, including its software, design, brand, and content (other than User Content and licensed third-party data), is owned by Fundry and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All other rights are reserved.

9. Not Investment Advice

Outputs from the Service — including suggested ARVs, rehab estimates, projected profits, cap rates, cash-on-cash returns, and verdicts — are informational and do not constitute financial, investment, legal, tax, accounting, real estate, or appraisal advice. Real estate investments involve risk, including loss of principal. Consult licensed professionals before making any investment decision.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FUNDRY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA SURFACED THROUGH THE SERVICE IS ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDRY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, AND (B) ONE HUNDRED U.S. DOLLARS.

12. Indemnification

You agree to indemnify and hold Fundry harmless from any claim, loss, or demand (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your breach of these Terms.

13. Termination

You may stop using the Service or close your account at any time from account settings or by emailing support@fundry.io. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to the Service or other users. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnification, governing law) will survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles. The exclusive venue for any dispute will be the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date of an update constitutes acceptance of the updated Terms.
